Dutch court denies suit of woman who claimed emotional damages after losing lottery

AMSTERDAM, Netherlands: A Dutch woman who claimed she suffered emotional damages due to not winning the lottery missed the jackpot in court too.

Amsterdam District Court judges Wednesday rejected the claim of Helene de Gier, who said she was traumatized by not winning the country's National Postcode Lottery, which she didn't enter, while her neighbors did.

In the lottery, postal codes are chosen at random, and people who live there and enter can win prizes ranging from a few euros (dollars) up to millions. Proceeds go to charity.

De Gier lived on a street in the small southern town of Heusden where seven entrants won €13.9 million (US$18.6 million) each on Jan 1, 2006.

Together with her husband, she filed a suit, arguing that the lottery was an invasion of privacy because she could not escape the media attention surrounding the town's selection. Afterward, neighbors allegedly rubbed in their victory, including one who ostentatiously displayed a new Porsche in front of his house.

De Gier said she eventually become obsessed with the loss. She said she was constantly confronted with it when writing her postal address.

The thought of the next lottery draw felt "like a noose around my neck being tightened," she told television program Nova, wiping away tears.

In addition, she said the lottery uses advertisements that amount to "emotional blackmail," because they emphasize the regret people who do not participate will feel when their neighbors win.

"In other lotteries you would never know for sure that if you had only participated you would have won," she said.

Judges were not swayed, saying that was no different in any lottery or game of chance where — after learning the result — observers know that if they had bet on the actual outcome, they would have won.

They conceded that the lottery had caused divisions in Heusden, but said that was "simply a result of living in a small community."

Sometimes "things happen that have unpleasant consequences for someone, but that doesn't automatically mean the one causing them can be held liable," judges said in a summary of their written ruling.

The National Postcode Lottery called the ruling "clear as a bell."

"We hope that Mrs. De Gier will come to appreciate the positive aspects" of the lottery, it said in a statement.

De Gier denied a charge that has repeatedly been leveled at her since she launched her legal action.

Jean, you have given this forum a very different flavor – I like it! You obviously are a talented individual, if not a little bruised from your encounters with the 'world out there,' where competitions are not always won fairly and squarely.

My atheistic leanings are not leanings of disbelief in a divine absolute power, or a singularity from which all other manifestations are manifest, it does not really matter if you call this energy Krishna or The Burning Bush, same, same.

What I absolutely hate with a passion are the religions of this confused world. Listen to the audio link in my original Thoughtful Atheist thread. I doubt you would find the speaker lacking in interesting and thought provoking discourse.

Sometimes boredom can lead us to drink from unhealthy waters. Besides, NASA seems to be the public diversion from the militarization of space. Do you really want to be a lap dog for Bush & Co?

Hello There Homer, You know it's funny but my nickname in highschool was actually "talented & somewhat bruised" Highschool obviously does never end....just like the song laugh.gif

I am busy setting up a fanclub, and I will defintely let you join, just because I'm not in space doesn't mean I'm not important... , the first year has no fees, so that'll be a bonus.... I can't actually listen to the audio clip as I have to use my own computer for the subversive type stuff and it's velllly old... NASA are very anti GR for some reason.... something to do with Angrezi....I think.... George Bush is mortal and very sick.... (see why I use my own computer) I am very much against NASA nowadays since becoming more open to the transcendental but being here at the moment gives me time to think....Yes I know Lisa, she would always be the one on the nights out passing out the drugs.... a wild card really .... She had alot of great qualities though.... brilliant at karaoke, a fantastic dancer.... Seeing her fall must be sad for all Americans, NASA being the "emblem" of independance and meaning...Her children were beautiful too... all high achievers. I have been writing letters of support... I will hopefully hear back soon. I know she is very busy.

I better go... I need my glucose shots.... catchya

bomb.gif George Bush is well known in government circles to be on Anti-Psychotic medication. I can say that here, it's actually a joke in NASA but really it's not actually funny. Someday I wish to start a new life, away from here and write about my experiences but I don't want to put myself in danger ! It's a big burden. FLOWERS.GIF GR is my sanctuary.
